  • Legislative Update For Week Ending January 8 2016

    This week, one new cosponsor – Rep. Zoe Lofgren (CA-19) – signed on to Rep. Grace Meng's (NY-6) Notch Fairness Act (H.R. 314), bringing the total up to twelve. If signed into law, H.R. 314 would provide modest compensation to victims of the Social Security Notch, or those who were born between 1917 and 1926. .Medicare Part B enrollees who don't receive Social Security benefits. This includes people who have delayed the start of Social Security benefits, and all people who are billed for Medicare. According to a report from the Kaiser Family Foundation, in 2013, about half of all people on Medicare who don't yet receive Social Security had incomes below ,000. .Industry groups and health systems led by the American Hospital Association challenged the rule, arguing that the rule would do more harm than good because it won't "tell consumers their actual out-of-pocket costs, will likely produce confusion and may be less effective than the price-transparency tools the hospital field has been developing." … Continued

Prior to 1984, Social Security benefits were excluded from taxation. Today, from 50 to 85 percent of Social Security income can be subject to taxation depending on two income thresholds. For taxpayers with incomes between ,000 and ,000 (individual) or ,000 and ,000 (filing jointly), up to 50 percent of Social Security benefits may be taxable. For individuals with incomes above ,000 or couples filing jointly with incomes above ,000, up to 85 percent of benefits may be taxable. .Senior housing experts say they frequently hear clients say they want to live in their own homes. But over time, it can become a great burden, especially when people don't have family that lives close by. Health and physical changes can make it difficult to climb stairs, keep the home clean, and keep up with paying bills. There may be a growing need for help with simple chores like driving to the pharmacy or grocery store. Home maintenance and repairs can even become a source of exploitation from unscrupulous vendors. .Social Security's "full" retirement age is the age at which you qualify for full, un-reduced benefits. It's based on your date of birth, so it varies for everyone. In 1983, Congress enacted changes that very gradually raised the full retirement age to age 67 by the year 202The full retirement age for people born between 1943 and 1954 is 6For those born in 1955 it is 66 and 2 months and it goes up 2 months per year for those born between 1956 and 195For people born in 1960 and thereafter, the full retirement age is 67. .Federal law requires that any reduction in payroll tax revenues going into the Social Security Trust Fund must be replaced dollar-for-dollar with general revenues from the U.S. Treasury. Consequently, a temporary extension of the payroll tax cut will have no effect on the Social Security Trust Fund. .Unlike the way Medicare negotiates costs for all other medical services and medical equipment, the program doesn't have the authority to negotiate drug prices. That leaves older U.S. consumers paying higher prices than people who get their medications through the VA Administration or state Medicaid programs. And because Medicare isn't negotiating on our behalf, there's no consistency in drug pricing between Part D drug plans either. Prices vary enormously, and new research for TSCL indicates millions of drug plan enrollees are getting gouged when they don't compare and switch to better plans. .The calculation of the COLA is based on the percentage of difference in the average third quarter change in the Consumer Price Index for Urban Clerical Workers and Wage Earners (CPI-W) from one year to the next. In late August of 2005, Hurricane Katrina knocked out petroleum production, causing gasoline and other consumer prices to surge in September. The CPI-W shot up an astonishing 1.5 percent between August and September of that year. But since Katrina, the CPI-W has increased .042 percent on average from August to September. "Even if costs were to rise as much as they did after Katrina, the COLA for 2018 would still be about 2 percent," Johnson says. .An unusually steep drop in inflation has slightly improved the buying power of Social Security benefits this year — by about 9%. Research for The Senior Citizens League has found that Medicare Part B premiums are one of the fastest growing costs in retirement. Medicare Part B premiums, which are automatically deducted from Social Security checks, often consume most, or even all, of the COLA increase.
