  • Legislative Update August 2018

The total revenues in the sample could pay the Social Security benefits of 897 retirees, with an average monthly benefit of ,400, for an entire year. Or, that revenue could be used to provide a modest boost to the COLA of 448,560 retirees in the first year, by tying the annual inflation adjustment to the Consumer Price Index for the Elderly (CPI-E). .Finally, two new cosponsors – Reps. Carol Shea-Porter (NH-1) and Juan Vargas (CA-51) – signed on to the Empowering Encore Entrepreneurs (E3) Act (H.R. 4613), bringing the total up to four. If signed into law, the E3 Act would direct the Small Business Administration (SBA) to increase training and mentoring efforts for older entrepreneurs. More than 7 million older Americans are currently self employed, but many of them lack the training and technical expertise that is necessary in order to see success. By expanding outreach efforts, the SBA can help empower seniors and enhance their ability to revitalize the economy. .But for more than two months, state inspectors failed to enter half the country's homes — a revelation that prompted CMS to crack down. … Continued

  • Medicare Q A

The Social Security COLA is calculated using the consumer price index. There are several of them, and the government uses the Consumer Price Index for Urban Wage Earners and Workers (CPI-W) to calculate the annual boost. That index, though, doesn't measure how people 62 and older spend their money. It measures how younger working adults do. Seniors, however, have different spending patterns, and have to spend a growing share of their budget on healthcare, which in most years outpaces overall inflation. .The Moment of Truth Project report calls it a technical correction and argues that government would simply be making the CPI more accurate. But if that's true, why haven't the economists at the BLS gone ahead and changed it already? They can't. The reality is that it requires a legislative change. It's not simply a matter for BLS economists. It's a matter for Congress —the same lawmakers who are answerable to you and me. .To address this issue, my office put together a two-pronged approach both locally and nationally. First, we held a resources fair in South Los Angeles, focusing on identifying and combatting senior scams with service providers that offered direct assistance for attendees. Second, I introduced a bipartisan resolution to call attention to the barrage of fraud attempts that seniors face nationwide. … Continued

Help! I'm turning 65 soon. My daughter says I should sign up for Medicare, but I don't know what to do or where to begin. I work for a small company with 17 employees, where I get my health insurance now. About a week is currently taken out of my paycheck for premiums. My current health coverage isn't that good. It has a ,500 deductible and, because I'm still in good health, I've never been able to benefit. .While not all generics work the same or as well as brand name drugs, they do work much or most of the time and the savings would be enormous. .During last fall's debt limit deal, Members of Congress passed legislation containing un-debated, secret provisions that made two major changes to Social Security benefit claiming strategies. The changes cut the expected retirement income of some married couples already at full entitlement age. Do you believe entitlement cuts are necessary in exchange for your vote to lift the debt limit in the future? .President Obama Releases 2015 Budget .The order is a direct response to the President's efforts to greenlight the importation of drugs from Canada. .Who are these beneficiaries? The Inspector General's report refers to these beneficiaries as dependents and survivors of other Social Security beneficiaries and subject to the Social Security Alien Nonpayment Provision (ANP) law. The ANP forbids payment of retirement, survivor and disability benefits when non-citizens have been outside the United States for more than 6 months. But as is so often the case with Social Security law, there are several exceptions; for example, if the non-citizen is from a foreign country that has its own social insurance system and meets certain conditions. Mexico is on the list of countries that meet the conditions of the exception. .Coronavirus and the U.S. Drug Supply .On Tuesday, Senators on the influential Finance Committee held a hearing titled "Examining the Proposed Medicare Part B Drug Demonstration." Dr. Patrick Conway testified before the full committee on the status of the controversial demonstration program, which was proposed by CMS earlier this year and has not yet been implemented. The program will test new payment strategies for hospitals and physicians who administer prescription drugs to Medicare beneficiaries receiving outpatient care. It is a new attempt by the Obama Administration to move away from a medical system that rewards volume of care and towards one that values high-quality care. .We have been reporting recently that unless Congress passes new legislation soon there will be significant cuts in Medicare payments to health care providers, such as doctors and hospitals. If that happens it is quite possible those patients covered by Medicare would likely face negative consequences with regard to their health care.
