The OIG recommends that CMS should pursue legislation to extend the statute of limitations so that the recovery period exceeds the reopening period for Medicare payments. In addition, the OIG recommends that CMS develop a system to verify that the amount reported collected has actually been collected. TSCL heartily supports these commonsense recommendations. With Congress debating a major Medicare overhaul that would make seniors pay a higher portion of Medicare costs in the future, Congress should move quickly to close the statute of limitation loophole that's costing us millions in lost recoveries. … Continued

The third piece of legislation they should pass is the National Defense Authorization Act (NDAA) for 202It has always been considered to be "must pass" legislation because it authorizes so many things for the military, including pay. But as we reported last week, President Trump has threatened to veto the bill because it doesn't contain a measure that he wants passed having to do with the regulations of social media like Twitter and Facebook. .The President ordered a payroll tax deferral, not a cut, meaning the taxes will not be collected for a while but they will still be due at a later date. However, some observers have suggested that rather than give employees the additional money and then try to collect it back from them at the end of the year, employers will simply hold onto the money so that the employees would never see it in their paychecks. .However, it differs from the House version which means it must go back to the House to see if it will agree with the changes that were made. .There will likely be court challenges to the President's actions, making it unclear how quickly any money would reach the unemployed. On top of that, it is unclear how many states will want to participate in this enhanced unemployment program or how many companies will want to suspend payroll taxes for employees only to have to pay them in 2021. .The report found similar price disparities in expensive specialty drugs that treat complicated conditions like cancer. .How can I get involved/help out? .By Jessie Gibbons, Legislative Director .To counter concerns over the cost of "fixing" the Notch and the financial solvency of the Social Security Trust Fund, TSCL backs an alternative "capped-cost" solution. "The Notch Fairness Act" would provide Notch Babies born from 1917 through 1926, or their survivors who receive benefits based on their accounts, a choice of either improved monthly benefits, or a lump-sum of ,000 payable over a four-year period. Recent surveys of TSCL members show more than 75% favor the lump-sum legislation. .No further information about the bill is available at this point but as soon as it is TSCL will review it to determine whether we will support it.
