Legislative Update July 2012
First, in the spring, Members of Congress passed legislation to repeal and replace the sustainable growth rate (SGR) – a flawed formula that set payment rates for doctors who treated Medicare patients. Because of the quirks in the law, doctors were faced with double-digit cuts year after year. Some stopped seeing new Medicare patients, and some even stopped participating in Medicare altogether. TSCL advocated for the SGR's repeal for more than a decade, and we were ecstatic to see it replaced once and for all last April. The law took effect immediately and, in the coming years, it will bring increased stability to the Medicare program for both patients and their doctors. .The "grandparent scam" has been around for a while, where a scammer poses as a relative, often a grandchild, in a desperate situation in urgent need of money. Due to the economic crisis created by the pandemic, the Federal Communications Commission has worked to raise the awareness of the grandparent scam. .This week, The Senior Citizens League released its final estimate for the 2019 Social Security cost-of-living adjustment (COLA), and four key bills gained support in Congress. … Continued

The COLA also doesn't reflect cost increases in Medicare premiums and other rapidly growing Medicare costs. Research for The Senior Citizens League has found that Medicare Part B premiums are one of the fastest growing costs in retirement. Medicare Part B premiums, which are automatically deducted from Social Security checks, often consume most, or even all, of the COLA increase. .If these cuts ever went into effect, it could mean tens of millions of seniors no longer have access to their doctors and essential healthcare services. This is unacceptable. For too long, Congress has failed to seriously tackle the issue of physician payment reform, and instead has kicked the can down the road with short-term fixes that have now created a long-term fiscal nightmare. This has been the absolute wrong approach for American seniors and our federal budget. And that is why I have been working hard to protect seniors' access to their doctors by putting forth a plan to fix this broken system once and for all. .Take all your prescriptions, vitamins, and supplements with you on your next visit to the doctor. Find out whether you still need to take them all and if there is a less-expensive brand name or generic you can try before settling on new medications. … Continued
"We need to get committees working again. We need to recommit to a rational, functioning appropriations process," McConnell said on the floor of the Senate during the first full day of his Senate leadership. "We need to open up. the legislative process in a way that allows more amendments from both sides." .Even Republicans who support changing the regulations are opposed to putting it in the NDAA and they may support an effort to pass it and try to override the President's veto, which would be the first of his presidency. .Medicare Extra Help helps pay for some, or most, of the out-of-pocket costs for Medicare prescription drug coverage. If you worked for someone else, Social Security will need your gross earnings prior to deductions for taxes. In addition, Social Security counts when the wages are earned, NOT when they are paid. This includes accumulated sick or vacation pay and bonuses. .Diversify if you can. If you have the savings, it might be wise to spread your investment between two companies or consider having a portion of yours savings in fixed annuity and a portion in a variable annuity. .This study illustrates why legislation is needed to provide a more fair and adequate COLA. To put it in perspective, for every 0 worth of groceries a retiree could afford in 2000, they can only buy worth today. To help protect the buying power of benefits, TSCL supports legislation that would provide a modest boost in benefits and base COLAs on the Consumer Price Index for the Elderly (CPI-E) or guarantee that the COLA would be a minimum of 3 percent. To learn more, visit . .The Social Security Administration recently called a halt to a controversial effort to collect debts that were more than 10 years old. For the past three years the government has confiscated tax refunds of hundreds of thousands of taxpayers, claiming an overpayment of Social Security benefits, even though it had little or no proof, and few exact details, according to media reports. In a letter to Treasury Secretary Jack Lew, Senator Charles E. Grassley (IA) said that government agencies were apparently "not properly notifying individuals or allowing them to inspect records of the debt they supposedly owe, which are violations of the law." .Last Friday the Chairman and Chief Executive Officer of Pfizer, Inc., urged President Biden to form a bipartisan coalition in Washington to address high drug costs.
