Major Immigration Legislation To Include Path To Social Security For Illegals
Why ban the use of earnings from unauthorized work to determine Social Security benefits? Under current law Social Security uses all earnings to calculate Social Security benefits. That means earnings of unauthorized immigrants from jobs worked under invalid and fraudulent Social Security numbers (SSN) can be used both to qualify for benefits and for the calculation of the initial retirement benefit. There is no official published data on the amount of wages on file attributable to aliens working without authorization, but the Social Security Administration maintains an earnings suspense file that represents an estimated 3.5 billion in wages from 2000 through 2010[2], most of it believed to be attributable to illegal workers. Under immigration reform, that could mean a huge new liability for Social Security in the future, triggering more rounds of cuts and higher taxes. .Some Members of Congress question whether the federal government would replace borrowing for Defense with borrowing for Medicare. Democratic Rep. Allyson Schwartz (PA-13) said the savings from the Iraq and Afghanistan wars would "offer a unique and limited opportunity to resolve this problem that grows every month." Other legislators warn, however, that it is misleading to think that these savings could be used as a "doc fix" offset. .Last week we told you that President Trump issued four executive orders concerning prescription drug prices. After being suspended since November 2, 2015, the debt cap was reinstated last week. "Although the Treasury secretary is using ‘extraordinary measures' to fund the budget for now, a failure to lift the debt limit in time would affect all Americans, including the timely payment of Social Security benefits," says TSCL Social Security and Medicare policy analyst, Mary Johnson. .In addition, the hold harmless provision does not apply to the premiums of Medigap supplements, Medicare Advantage, or Part D plans. Any increase in those premiums would lower the amount of Social Security benefits left to deal with other rising costs. .New legislation before the House and Senate would repeal the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO) so that public servants receive the Social Security benefits they have earned and deserve.
