  • Legislative Update Week Ending January 19 2018

    On Monday, lawmakers in the House revealed the American Health Care Act (AHCA), which would replace the Affordable Care Act (ACA) if signed into law. Just two days later – before the Congressional Budget Office had a chance to evaluate the proposal – Republicans on the House Ways and Means Committee and the House Energy and Commerce Committee voted to advance the proposal. .It's not what the government tracks that causes your Social Security cost-of-living adjustments (COLAs) to grow so slowly. It's what the government isn't tracking that's keeping your COLAs so low. It may surprise you, as it did us at TSCL, to recently learn that COLAs are calculated using methodology that doesn't directly measure what you pay out-of-pocket for health insurance premiums. Add to that the fact that the consumer price index (CPI) the government uses to calculate COLAs (CPI-W) represents the spending habits of younger urban wage earners and clerical workers — or the spending habits of only 29% of the U.S. population. That's certainly not going to reflect the inflation experienced by most Social Security recipients. .Tuesday's hearing made it clear that the Joint Committee has an enormous amount of work to do in a very short amount of time and in a very politically-charged environment. Adding to the pressure, Elmendorf told the Committee Members that if they wish to have their proposal scored by the CBO before voting on it, they'll need to submit it by early November, giving them less than two months to reach a compromise.     This week, Rep. Paul Ryan (WI-1), Chairman of the House Ways and Means Committee, revealed that Congress will not consider legislation that would permanently repeal and replace the SGR – the flawed formula that sets payment rates for doctors who treat Medicare patients – before the March 31st deadline. Instead, they will likely pass another short-term "doc fix" in order to avert a 21 percent pay cut for physicians that is set to hit on April 1st. ."We need to get committees working again. We need to recommit to a rational, functioning appropriations process," McConnell said on the floor of the Senate during the first full day of his Senate leadership. "We need to open up. the legislative process in a way that allows more amendments from both sides." .This week, the Congressional Budget Office (CBO) released a report on the nation's long term budget outlook, and Doug Elmendorf – CBO's Director – met with the House Budget Committee on Wednesday to discuss the findings. The proposal calls for switching to a more slowly-growing consumer price index (CPI), known as the "chained" CPI, to calculate annual COLAs. Chaining is an apt name for it because that's what it would do to benefits — chain them down. .In addition to congressional committee work in the 116th Congress, several new bills have been introduced that would reduce prescription drug costs. Several of them – including the following three – have already won bipartisan support in the new Congress. .As TSCL supporters well know, Congress has not been able to accomplish significant legislative reform to the convoluted drug pricing system even though anger about high drug prices has been rising for a long time. .Rep. Rosa DeLauro (CT-2) introduced H.R. 4998 on June 26, 201It has since been referred to the Committee on Ways and Means. .Throughout the hearing, the witnesses stressed the importance of acting quickly, before reform options run out and seniors are left with a 23% benefit cut. Despite their pleas, however, it doesn't seem like Congress will be ready to compromise on Social Security reform any time soon. .Older Americans have lost more than 22% of their purchasing power since 2000, and this year Social Security beneficiaries received no COLA despite a national survey indicating a majority reported higher costs.
