Over the years, there have been many bills, some with large numbers of co-sponsors, to fix the Notch. Most of the proposed legislative "fixes" provided improved monthly benefits. The therapy cap sought to keep the Medicare budget under control but often hurt patients who need care after traumatic medical events. In practice, this cap limits access to Medicare - covered rehabilitation services. Patients are faced with either footing the bill for additional expensive care out of their own pocket or purchasing additional supplementary coverage if they can afford it. .The CMS rule change would also make it more difficult to qualify for nursing home and even home health care coverage after leaving the hospital. To qualify for nursing home coverage, one must spend three days as an inpatient. Outpatient stays do not qualify for Medicare coverage of nursing home stays.
