  • Legislative Update Week Ending March 3 2017

    On Wednesday, the Senate Finance Committee held a hearing to question Congressman Tom Price (GA-6), an orthopedic surgeon from Georgia who was nominated by President Trump to become the next Secretary of the Department of Health and Human Services (HHS). If confirmed, Congressman Price will lead the agency that has jurisdiction over Medicare, Medicaid, Social Security, and many other critical health programs. .According to Rep. Roskam, the bill would enhance data sharing between states and agencies so that they can more easily catch scammers, and it would modernize outdated fraud prevention systems. Upon introducing the bill, Rep. Carney said, "In this Congress, it's not easy to find areas where Democrats and Republicans agree, but fighting waste, fraud, and abuse while saving billions of taxpayer dollars just makes sense." .The Senior Citizens League (TSCL) shares Senator Nelson's concerns, and we are hopeful that Congress will take action in the near future to ensure lower out-of-pocket spending for Medicare beneficiaries. The Office of the Actuary stated that it has difficulty "in determining what portion of taxes paid to and benefits received from the Social Security Trust Fund are derived from the earnings of immigrants working without authorization." The obtuse note was frustrating to dissect as there was no discussion on the reasoning behind assumptions and there was no attempt to estimate the long-term cost in Social Security benefits of unauthorized work. Here are some eye-opening points that the Office of the Actuary did provide: .In 1977 Congress enacted changes to the Social Security benefit formula that affected seniors just two years from first entitlement to Social Security. A transitional formula supplied by Congress to phase in the changes, failed to prevent abrupt cuts and big disparities – as much as 1.80 per month in the well – publicized case of two sisters who worked for the same company. .For each visitor to our website, The Senior Citizens League collects only the domain name and aggregate information on what pages are visited. "Gag clauses" prevent pharmacists from telling consumers when it would be cheaper to purchase their prescriptions out-of-pocket than through their Medicare Part D or health insurance plans. .Obama's controversial executive action would defer the deportation of up to five million illegal immigrants, including older adults who have children who were born in the U.S. (and thus U.S. citizens). In addition, his executive actions provide the work authorization required to receive Social Security and Medicare, once other qualifications are met. Texas and 25 other states are challenging the legality of Obama's actions. They are being supported by TSCL, 12 other groups, and 113 Members of Congress who argue in an amicus brief, that "the President acted contrary to both the express and implied will of Congress." .Do COLAs overpay seniors? Ask TSCL Chairman, Larry Hyland. "The idea is hogwash," he says. "There's simply no evidence that the CPI has overpaid the people who depend on those COLAs to protect the buying power of their benefits. The Consumer Price Index for the Elderly (CPI-E) that surveys the market basket more typical of the majority of Social Security recipients, has shown a significantly greater rise over the CPI used to calculate COLAs through 201The CPI-E would provide a more accurate, and adequate COLA, one more in line with the costs experienced by seniors," Hyland says. .This week, TSCL announced its support for two bills that would prevent a spike in next year's Medicare premiums and deductibles for approximately 30 percent of enrollees. Senate Finance Committee Chairman Ron Wyden (OR) introduced the Protecting Medicare Beneficiaries Act (S. 2148) on Wednesday with the support of nine original cosponsors. Rep. Dina Titus (NV-1) introduced similar legislation in the House called the Medicare Premium Fairness Act (H.R. 3696).
