In July of 2011, the Department of Health and Human Services proposed a rule under the Patient Protection and Affordable Care Act regarding risk adjustment. Under this rule, the Federal Government is requiring health insurers to provide confidential and detailed medical information about a person. Aside from the fact that this is an invasion of privacy, we must also remember the Federal Government's lack of accountability with health records when over 5 million TRICARE records were stolen from the car of a government contractor this past fall. .Earlier this year, I introduced the Today's American Dream Act (H.R. 1084) to ensure that mature workers can get those new skills and get back to work. This bill contains two key provisions. The first creates and expands computer skill and resume writing job-training programs, exclusively for workers over the age of 5The second adds greater flexibility to existing programs so they can better target and serve mature workers who have unique skill gaps and needs, often because of family commitments. .At Wednesday's hearing, Charles Jeszeck – Director of Education, Workforce, and Income Security at the Government Accountability Office (GAO) – unveiled the findings of a study requested by the Aging Committee's leaders back in March of 201The study examined the extent to which older Americans understand the rules that impact their future benefits when making claiming decisions, and the quality of the information provided by the agency and its field offices around the country. .TSCL is hopeful that the bill will fail to win passage in the House since it would negatively impact older Americans if adopted. The AHCA would restructure the Medicaid program, which helps fund health care for 11 million – or around 1 in 5 – Medicare beneficiaries. It would also base premium subsidies on age instead of income, and allow private health insurers to charge older Americans more than they charge younger folks for their coverage. In addition, it would deplete Medicare's Hospital Insurance Trust Fund by eliminating a key revenue source, and the program would face an immediate funding crisis. .Why ban the use of earnings from unauthorized work to determine Social Security benefits? Under current law Social Security uses all earnings to calculate Social Security benefits. That means earnings of unauthorized immigrants from jobs worked under invalid and fraudulent Social Security numbers (SSN) can be used both to qualify for benefits and for the calculation of the initial retirement benefit. There is no official published data on the amount of wages on file attributable to aliens working without authorization, but the Social Security Administration maintains an earnings suspense file that represents an estimated 3.5 billion in wages from 2000 through 2010[2], most of it believed to be attributable to illegal workers. Under immigration reform, that could mean a huge new liability for Social Security in the future, triggering more rounds of cuts and higher taxes. .Prior to being elected to Congress in 2010, I spent the past 15 years as a practicing cardiothoracic surgeon.
