Legislative Update For Week Ending September 20 2013
It would have to report to Congress every two years on regulatory and financial developments that affect older investors. Reports would have to include recommendations for possible regulatory or legislative action. .In 2008, an audit by the Social Security Administration's (SSA) Office of Inspector General found that spouses did not always receive the higher retirement benefits due them. Although 18,768 spouses were identified as eligible for higher retirement benefits in that audit and the SSA developed a notification letter, the agency took no further action to notify beneficiaries – citing "limited resources." As a result, these spouses never received the higher retirement benefits for which they were eligible. .Congress should change the law to apply the Social Security payroll tax to all earnings, instead of the first 2,800 of earnings, to strengthen program funding. — 72 percent support, 19 percent opposed, and 9 percent favored other types of revenue increases. … Continued
More than 61 million people, including adults age 65 and older, and younger disabled adults who receive Social Security disability benefits, get their healthcare coverage though Medicare.[3] The Social Security hold harmless provision protects about 70 percent of beneficiaries (almost 43 million beneficiaries) from increases in the Medicare Part B premium that exceed the dollar amount of their COLA. When an individual's Part B premium increases more than the dollar amount of his or her COLA, the Part B premium is reduced to prevent a reduction in net Social Security benefits from one year to the next. .Have you heard anything about congress fixing a Social Security cut for those of us born in 1960? — K.S. .If your problems persist and you have trouble collecting your back due Social Security payment, contact the constituent services staff member of your Representative in the House or one of your two Senators here. .If signed into law, the Improving Access to Medicare Coverage Act would amend the Social Security Act to allow individuals receiving "outpatient observation services" in hospitals to be considered "inpatients" so they may satisfy the three-day requirement for Medicare coverage of post-hospitalization care in skilled nursing facilities. Currently, Medicare does not cover skilled nursing care for those who spent time in the hospital under outpatient observation, and they are billed unfairly for necessary medical care. .TSCL recently submitted comments on the draft FDA regulations, stating "classifying CAM products as drugs, the cost of access would increase, as consumers may have to visit and pay a doctor for a prescription, instead of being able to choose their own vitamins, minerals and dietary supplement intake." TSCL is further concerned about the impact such regulation would have upon Medicare beneficiaries. Currently, Medicare reimburses few CAM therapies and products and seniors must pay out of pocket. Most Part D drug plans, for example, don't cover vitamins and supplements. TSCL called on the FDA to withdraw the regulations. .Congressman Bill Pascrell (D- N.J.) was very blunt when he said that all the talk about fixing Social Security is just platitudes. While both sides of the aisle know it needs to be fixed and say they want to fix it, nothing is really being done. .The fraudsters enlist unscrupulous doctors to approve the test and the doctor receives a kick back from the recruiting company for each prescription. Medicare receives a bill that can range from ,000 to ,000. Victims have later reported that they did not even know the doctor who prescribed the test. Law officials warn that health fairs, senior centers and even church events are magnets for the scam, where recruiters take cheek swabs for genetic testing and collect Medicare numbers. .Individuals with incomes below ,000, and whose Part B premiums are automatically deducted from their Social Security benefits, are protected from a reduction in their Social Security benefits when Part B premiums increase more than their Social Security benefits. The provision was triggered twice in recent years, in 2016 when there was no COLA, and in 2017 when the COLA was just 0.3%. .However, we believe Congress can and must do more to reduce prescription drug prices. In the months ahead, we will continue to advocate for legislation like the Medicare Prescription Drug Price Negotiation Act (S. 41, H.R. 242), the Affordable and Safe Prescription Drug Importation Act (S. 469, H.R. 1245), and the Improving Access to Affordable Prescription Drugs Act (S. 771, H.R. 1776).
