Visit TSCL's Retirement Resource Center. .The payraise goes into effect automatically unless denied by legislation, or adjusted by a provision of law that prevents Congress from receiving a percentage of pay increase that would be greater than any payraise received by the General Schedule to federal workers. When Congress passed legislation in December of 2010 that froze the pay of federal workers through December 31, 2012, they effectively froze their own pay as well. No similar provision of law, however, prevents Congress from receiving a bigger COLA than seniors. The adjustment for Congress is not determined like the COLA for seniors, which is based on changes in consumer prices. Instead the Congressional COLA is based on changes in private sector wages and salaries as measured by the Employment Cost Index. Members of Congress were originally scheduled to receive a pay adjustment in January 2010, of 2.1%, and in 2011 of 0.9% had legislation not prohibited it. .Because the economic fluctuations were highly unusual and unforeseen, logic dictates that Congress could not have intended the benefits that Notch Babies actually received. The disparities in benefits under the actual conditions of double-digit inflation are illustrated in the following chart, which was not developed until 199Even if Congress had developed this chart in 1977, however, they would have seen benefit differences of only 10%-14% shown on the left-hand side of the chart. Instead, the effects of inflation are reflected by benefit differences of 13% to 30% shown on the right. In effect, the actual benefit reductions for many retirees were more than double what original projections would have been at the time. .And the American government has no effective way to fight back. .TSCL believes COLAs need to be more fairly and accurately calculated, and strongly supports recently introduced legislation that would provide an emergency COLA. TSCL estimates that 2.7 million Notch babies and their spouses or widows would benefit from passage of The Notch Fairness Act. The legislation would provide Notch Babies, born 1917 through 1926, ,000 payable in four annual installments, or an improved monthly benefit. Representative Mike McIntyre (NC-7) introduced the legislation in the House where it has 17 cosponsors, and Senator David Vitter (LA) has introduced a corresponding bill in the Senate.
