  • Legislative Update Week Ending August 4 2017

    New legislation before the House and Senate would repeal the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO) so that public servants receive the Social Security benefits they have earned and deserve. Will you cosponsor the Social Security Fairness Act (S. 521, H.R. 141) when you return to Washington on Monday? .Currently, when hold harmless is triggered on a nationwide scale there is no provision of law to finance the unpaid portion of Medicare Part B premium increases. Instead, the entire burden of Part B costs is spread over a much smaller number of individuals, which is the 30 percent of Medicare Part B enrollees who are not protected by the hold harmless provision. This has led to significant spikes in Medicare Part B premiums during the hold harmless years, and in 2018 when a COLA finally became payable, to steep jumps in premiums for those whose Medicare Part B premiums were held lower in 2016 and 2017. .In a recent high profile Medicare fraud takedown, actor and entrepreneur Roberto F. Marrero, who played bits parts on Miami Vice, America's Most Wanted, and Unsolved Mysteries, was arrested for massive Medicare fraud. Marrero, who became a Medicare-licensed healthcare provider in 2007, is accused of submitting million in bogus bills for supplying purported home healthcare services for diabetic patients. … Continued

This week, lawmakers in the House and Senate adjourned for a week-long holiday recess. They are expected to return to Washington on Tuesday, June 5th. In the meantime, many Members of Congress will be attending local events or hosting town hall meetings in their home states and districts. .TSCL originally made this proposal with the massive support of our members. It is designed to provide fair compensation for the lower benefits Notch Victims receive. It has now been introduced as Bills in Congress. A statute of limitation loophole is hamstringing Medicare from recovering overpayments. Federal law allows a Medicare claims contractor to reopen a payment determination for "good cause" at any time within 4 years of the date the original payment determination was made. But another provision of law bars the recovery of overpayments from providers that are "without fault." And the law states that a provider is deemed to be without fault 3 years after the year in which the original payment was made unless there is "evidence to the contrary." .There are now efforts for legislation to boost domestic manufacturing of pharmaceutical products. There is a new measure that would require the National Academies of Sciences, Engineering, and Medicine to "convene a committee of experts to analyze the impact of U.S. dependence" on foreign medicines and to make recommendations to Congress. There is also an effort to use the fiscal 2021 defense authorization bill to strengthen U.S.-based pharmaceutical manufacturing and advance "make it in America" policies that favor domestic drug-production plants. .New criminal cases were filed in April against a Michigan doctor accused of pushing Vitamin C injections as a treatment, and a former "naturopathic" physician accused of peddling a "dynamic duo" of substances on Facebook that he claimed could kill the virus. .Despite the efforts of TSCL and others, knowledge of the U.S – Mexico Totalization Agreement remains limited on Capitol Hill, and the issue flies under radar for the most part. TSCL has expressed its support for resolutions in opposition to the totalization agreement. In addition, TSCL is supportive of legislation, such as the Social Security Totalization Agreement Reform Act, which would grant more time for congressional review of these agreements. TSCL also supports loophole-closing legislation which would prevent individuals who worked in the U.S. while illegal from receiving credit for that work for purposes of Social Security benefit calculations. .Are you at risk of a notch in your Social Security benefits?
