  • New Alzheimers Drug Sparks Controversy

    This week, one new cosponsor – Rep. Robert Scott (VA-3) – signed on to Rep. Peter DeFazio's (OR-4) Consumer Price Index for Elderly Consumers (CPI-E) Act (H.R. 1030). The cosponsor total is now up to ten. If signed into law, Rep. DeFazio's bill would base the Social Security COLA upon the spending patterns of seniors. Currently, it is based upon the way young, urban workers spend their money – a method that underestimates the spending inflation that seniors experience. A study conducted by TSCL in 2012 found that seniors have lost 34 percent of their purchasing power since 2000 – a clear sign that the current COLA is growing too slowly. .The entire process is done at the taxpayer's expense. Non-citizens who worked under fraudulent or invalid Social Security numbers, are not penalized. This occurs even though the use of a non-valid fraudulent SSN is in violation of 1988 identity theft laws. The 1988 law made it a federal crime when a person "knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law." The proposal would require that often-secretive discounts or rebates, received by pharmacy benefit managers from drug companies, would have to be credited at the pharmacy when a patient fills a prescription. For patients who need expensive drugs, out-of-pocket costs are likely to go down. .Finally, locality pay is subject to the approval of the President, and thus subject to politics. In 2019, the average locality pay adjustment was 0.5%. The annual COLA was 2.8%. The calculation has also been challenged by economists and the nonpartisan CBO as not being accurate. Typically, Social Security benefits tend to grow slightly each year as COLAs compound over time. But when the Medicare premium increases more than an individual's COLA that can trigger this special provision of law. Hold harmless protects Social Security benefits when the dollar amount of an individual's annual COLA increase is not sufficient to cover the increase in the Medicare Part B premium increase. If the increase in Medicare Part B premium would cause an individual's net Social Security benefit to be less than it was the year before, then the Part B premium is reduced to ensure the individual's Social Security benefit does not decline.
