House Democrats did not pre-negotiate terms with the GOP-Senate or the White House, so it is unlikely that the bill, called the Health and Economic Recovery Omnibus Emergency Solutions (HEROES) Act will become law in its present form. Senate Majority Leader Mitch McConnell (R- Ky.) has already pronounced the bill dead. But most observers believe it is the opening bid on the part of the House leaders to begin a process that will eventually lead to a fifth virus-related relief bill. .The FTC Advisory Group would bring together relevant government agencies, consumer advocates, and industry representatives to collect and develop model educational materials for retailers, financial institutions, and wire transfer companies to use in preventing scams on seniors. The FTC would coordinate efforts to educate the public and even the employees of key industries who often find themselves on the front lines of anti-scamming activities. .In addition, three new cosponsors signed on to the Preventing and Reducing Improper Medicare and Medicaid Expenditures (PRIME) Act (S. 1123 and H.R. 2305) this week, bringing the total up to twenty-four in the Senate and thirty-four in the House. If signed into law, the comprehensive bill would take a number of steps to prevent fraud, waste, and abuse within the two programs – a problem that TSCL believes must be addressed in order to ensure that scarce program dollars are being spent properly. Medicare Advantage plans have lower premiums, but you instead pay co-pays for every service. If you get sick or you are hospitalized, your out-of-pocket costs could be thousands of dollars. But unlike Medicare alone, Medicare Advantage plans have annual out-of-pocket maximums to cap what you pay. Those maximums average ,332 in 2017 but can be as high as ,700. .The House recently passed legislation the FAIR Act (H.R. 1423, S.610) that would prohibit mandatory arbitration agreements in employment, consumer, and other contracts. This week, one new cosponsor – Rep. Steve Israel (NY-3) – signed on to the Consumer Price Index for Elderly Consumers (CPI-E) Act (H.R. 1030), bringing the cosponsor total up to twenty-four. If signed into law, H.R. 1030 would adopt the CPI-E for the purpose of calculating Social Security cost-of-living adjustments (COLAs). Currently, COLAs are based upon the way young, urban workers spend their money – a method that underestimates the spending inflation seniors experience. H.R. 1030 would address this issue, resulting in more fair and accurate COLAs for seniors. .In a statement that was released shortly after the bill's introduction, Sen. Blumenthal stated, "The seniors who spent a lifetime working to make our country stronger deserve peace of mind that their retirement years will not be marked by suffering." TSCL could not agree more, and we look forward to working with Sen. Blumenthal and Rep. Cartwright in the coming months to help build support for their bill, and to help pass it into law. .But it turns out the Democrats are not quite as united as that statement makes it sound. Ten members recently sent a letter to House Speaker Nancy Pelosi (D-Calif.) expressing concerns about the drug pricing legislation as written. .Specialty-tier drugs are defined by Medicare, as those that cost more than 0 per month in 2019, and include drugs used to treat cancer, hepatitis C, multiple sclerosis (MS), and rheumatoid arthritis. Even when Part D enrollees reach the Medicare Part D catastrophic coverage phase, when co-insurance drops to 5%, beneficiaries who take these drugs can continue to face thousands of dollars in annual out-of-pocket costs, according to the Kaiser study. The study found that annual out-of-pocket costs for specialty drugs in 2019 are expected to average ,994 across the 28 specialty-tier drugs that are covered by drug plans. .Those receiving work authorization become vested for benefits with as little as ten years of earnings. The oldest of those who are eligible for the deferred action could potentially have worked illegally long enough to be "vested," or nearly so, for Social Security already — including disability benefits. Once illegal workers gain a work-authorized Social Security number, individuals who have evidence of earnings, even for jobs worked under invalid Social Security numbers, may claim and reinstate those earnings under their own number. The earnings are then later used to determine Social Security benefits. .Some financial advisors say that there may be some tax advantages to taking money out now while valuations are lower.
