Over the same period, costs for physicians of human patients rose just 0.7%. .In response to the OIG's findings, Representative Sam Johnson (TX-3) – Chair of the Ways and Means Social Security Subcommittee – said: "Overpayments are bad for everyone – they are bad for the beneficiary and they are bad for the taxpayer. With the disability program going broke next year, it is especially troubling that Social Security is failing to protect precious taxpayer dollars." .In view of what happened and the substantial differential in pure dollar terms, TSCL believes "The Notch Fairness Act" is a fair, and even modest settlement for those who were affected by the Notch. When proposals to change the benefit formula are debated, Members of Congress, the media, and the public tend to focus on the anticipated percentage of reduction. The danger of doing this, however, is that the assumptions used at the time often bear little resemblence to what accually occurs. .It remains to be seen whether or not Congress will adopt the recommendations made by MedPAC in its most recent report. The Commission is an independent Congressional agency, but its policy recommendations are non-binding and Congress rarely takes immediate action on them.
